1. Introduction
These Terms and Conditions (“Agreement”) govern the use of the services provided by Oz Qualify (ABN: 93 945 180 484) Trading as Oz Qualify, herein after (“we”, “us or “our”) an education consultant company located in Australia. By accessing or using the services provided by Oz Qualify, Client (“You” or “your” or “users”) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Definition

a. Oz Qualify: Oz Qualify means Oz Qualify (ABN: 93 945 180 484) Trading as Oz Qualify.

b. Introduction: The introduction provides an overview or opening statement that introduces the terms and conditions of a particular agreement or contract.

c. Services: Services refer to the specific activities, tasks, or offerings provided by a business or organization to its clients or customers. Oz Qualify is not a registered training organization (RTO). We are partnered with registered training organizations as a referral partner for the RTO’S.

d. Eligibility: Eligibility refers to the requirements or criteria that individuals or entities must meet in order to qualify for a particular service, program, or qualification. State and territory jurisdictions may have different licensing, legislative, regulatory or certification requirements. Relevant state and territory regulatory authorities should be consulted to confirm those requirements. Please check with your state licensing authority before using our services.

e. Client Obligations: Client obligations are the responsibilities, duties, or actions that clients or customers are required to fulfill as part of an agreement or engagement with a service provider.

f. Fees and Payments: Fees and payments refer to the charges or costs associated with the services provided by a business or organization, as well as the terms and conditions related to the payment process, including due dates, methods of payment, and refund policies.

g. Confidentiality and Privacy: Confidentiality and privacy pertain to the protection and handling of sensitive or personal information shared between parties involved in a business transaction, ensuring that such information is kept secure and used only for the intended purpose.

h. Partner RTO: Partner RTO’S refer to Registered training organizations that Oz Qualify is partnered with to gather all required (RPL) documentation from the client on behalf of the RTO.

i. Intellectual Property: Intellectual property refers to the legal rights associated with creations of the mind, such as inventions, trademarks, copyrights, or trade secrets. It involves the protection and ownership of original works or ideas.

j. Limitations of Liability: Limitations of liability define the extent to which a party involved in an agreement or contract can be held responsible or liable for any damages, losses, or claims that may arise from the provision or use of services.

k. Termination: Termination refers to the act of ending or discontinuing an agreement or contract between parties. It outlines the conditions, rights, and obligations associated with the termination process.

l. Governing Law and Jurisdiction: Governing law and jurisdiction specify the laws and regulations that govern the agreement or contract, as well as the jurisdiction or legal venue where any disputes or legal actions would be resolved.

m. Website Terms and Conditions: Website terms and conditions are the rules, policies, and regulations that govern the use of a website by its visitors or users. It includes provisions related to user conduct, content ownership, disclaimers, and limitations of liability. Website means www.ozqualify.com.au that is owned and operated by Oz Qualify, Trading as Oz Qualify.

n. Severability: Severability refers to the provision in a contract or agreement that states that if one or more provisions are found to be invalid or unenforceable, the remaining provisions will still remain in effect.

o.Contact: The contact information section provides the details for individuals or entities to get in touch with the relevant party involved in the agreement, such as a company’s address, phone number, or email address.

3. Services

Oz Qualify specializes in referrals of students to RTO’S for recognition of prior learning (RPL). The RTO’S will assess the prior learning and experience of individuals to determine their eligibility for qualification recognition.

Oz Qualify is not a registered training organization (RTO). We are simply a referral partner for RTO’S.

4. Eligibility

By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are accessing our services on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to this Agreement.

You must fit the criteria and hold the necessary experience in order to be eligible for (RPL) recognition of prior learning.

5. Client Obligations
Clients using Oz Qualify’s services are responsible for providing accurate and complete information regarding their prior learning and experience. It is the client’s obligation to cooperate fully and promptly throughout the qualification recognition process, including providing all requested documentation and attending any required assessments or interviews. Clients are responsible for any fees associated with the qualification recognition process as agreed upon with Oz Qualify.
6. Fees And Payments
Oz Qualify’s fees for services will be communicated to clients prior to the commencement of the qualification recognition process. Payment terms and methods will also be provided to clients. All fees are non-refundable once the qualification recognition process has commenced, unless otherwise agreed upon by both parties.
7. Confidentiality And Privacy
Oz Qualify is committed to protecting the confidentiality and privacy of its clients. Any personal information provided to Oz Qualify will be handled in accordance with applicable privacy laws and Oz Qualify’s Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your personal information as outlined in our Privacy Policy.
8. Intellectual Property
All intellectual property rights related to the services provided by Oz Qualify, including but not limited to trademarks, copyrights, and proprietary content, are owned by the Company. Clients agree not to reproduce, distribute, or modify any intellectual property belonging to the Company without obtaining prior written permission.
9. Limitations Of Liability
Oz Qualify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of its services. Oz Qualify’s liability, if any, shall be limited to the amount paid by the client for the services provided by Oz Qualify.
10. Termination
Either party may terminate this Agreement by providing written notice to the other party. In the event of termination, the client will be responsible for any fees or costs incurred up until the termination date.
11. Governing Law And Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.

12.1 Website Content
